L\u2019enfant a re\u00e7u une balle dans la t\u00eate apr\u00e8s que la police ait ouvert le feu sur une camionnette transportant des migrants pr\u00e8s de Mons. Cet homicide est la cons\u00e9quence de la r\u00e9pression des migrants \u00ab\u00a0sans-papiers\u00a0\u00bb organis\u00e9e par le gouvernement actuel qui force les personnes qui fuient la guerre, la pauvret\u00e9 et la r\u00e9pression \u00e0 devoir prendre toujours plus de risques pour \u00e9chapper aux forces de l\u2019ordre et ainsi esp\u00e9rer construire un avenir de l\u2019autre c\u00f4t\u00e9 de la Manche. Depuis, la famille Shawri a re\u00e7u un ordre de quitter le territoire ce qui fait qu\u2019apr\u00e8s l\u2019enterrement de leur enfant, les parents devraient choisir entre poursuivre clandestinement leur route vers l\u2019Angleterre, tenter d\u2019introduire une demande d\u2019asile chez nous qui n\u2019a quasiment aucune chance d\u2019aboutir ou accepter un rapatriement volontaire vers l\u2019Irak. De leur c\u00f4t\u00e9, les parents de Mawda demandent de postposer l\u2019enterrement pr\u00e9vu ce mercredi pour que puisse avoir lieu une enqu\u00eate parlementaire ind\u00e9pendante et qu\u2019ils puissent ainsi avoir l\u2019occasion de d\u00e9fendre les int\u00e9r\u00eats de leur fille dans cette enqu\u00eate.<\/p>\n<p><strong>Un droit de s\u00e9jour pour la famille<\/strong><\/p>\n<p>Concr\u00e8tement, la famille Shawri ne peut ni abandonner le corps de Mawda dans un cimeti\u00e8re belge et \u00ab\u00a0continuer la route\u00a0\u00bb ni rester en Belgique. Le pr\u00e9sident du CPAS de Mons o\u00f9 \u00e9tait log\u00e9e la famille Shawri d\u00e9clare que l\u2019 \u00ab\u00a0on se trouve donc dans une situation humanitaire d\u2019urgence\u00a0\u00bb. Face \u00e0 un gouvernement qui n\u2019entend que la raison juridique nous rappelons que, en principe, toute demande d\u2019autorisation de s\u00e9jour de plus de trois mois doit \u00eatre faite \u00e0 l\u2019\u00e9tranger, aupr\u00e8s du poste diplomatique ou consulaire belge dans le pays d\u2019origine de la personne qui fait la demande. Toutefois l\u2019article 9bis de la loi du 15 d\u00e9cembre 1980 relative \u00e0 l\u2019acc\u00e8s au territoire, au s\u00e9jour, \u00e0 l\u2019\u00e9tablissement et \u00e0 \u00e9loignement des \u00e9trangers pr\u00e9voit une d\u00e9rogation \u00e0 cette r\u00e8gle proc\u00e9durale permettant, dans certaines circonstances, d\u2019introduire la demande en Belgique lorsqu&rsquo;une personne s\u2019y trouve d\u00e9j\u00e0, souvent en s\u00e9jour pr\u00e9caire ou ill\u00e9gal. Si la personne s\u00e9journe d\u00e9j\u00e0 en Belgique et qu\u2019il lui est impossible ou tr\u00e8s difficile de retourner dans son pays d\u2019origine, elle peut introduire sa demande en Belgique pour circonstances exceptionnelles. Nous nous trouvons clairement dans une situation de ce type. C\u2019est pourquoi <strong>nous exigeons du Premier Ministre qu\u2019il accorde dans les plus brefs d\u00e9lais un droit de s\u00e9jour \u00e0 la famille Shawri pour raison humanitaire. \u00ab seule une r\u00e9gularisation imm\u00e9diate, non li\u00e9e \u00e0 la suite d\u2019une proc\u00e9dure judiciaire ou administrative, permettra aux parents de suivre l\u2019enqu\u00eate (\u2026) et d\u2019envisager leur deuil dignement \u00bb <\/strong>(Communiqu\u00e9 du Cir\u00e9, 23\/05\/2018).<strong> Ce droit de s\u00e9jour permettrait \u00e9galement, selon le souhait de la famille, que la justice puisse \u00eatre rendue \u00e0 Mawda via une enqu\u00eate parlementaire ind\u00e9pendante.<\/strong><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.change.org\/p\/charles-michel-pour-la-r\u00e9gularisation-imm\u00e9diate-et-d\u00e9finitive-de-la-famille-shawri?utm_medium=email&amp;utm_source=petition_signer_receipt&amp;utm_campaign=triggered&amp;share_context=signature_receipt&amp;recruiter=127412\">Signer<\/a><\/p>\n<p>Donderdag 17 mei 2018 werd Mawda Shawri, geboren in Duitsland, gedood door de Belgische politie, terwijl ze samen met haar ouders en haar broertje Irakees Koerdistan ontvluchtte in de hoop een menswaardig leven te kunnen opbouwen in het Verenigd Koninkrijk. Doordat de politie het vuur had geopend op een bestelwagen met vluchtelingen stierf Mawda ten gevolge van een kogel in het hoofd.\u2028Deze moord is het rechtstreekse gevolg van het repressieve beleid van de huidige regering ten aanzien van niet geregistreerde vluchtelingen waarbij mensen die oorlog, armoede en repressie ontvluchten steeds grotere risico&rsquo;s moeten nemen om te ontsnappen aan de klopjacht van de politie. Vervolgens heeft de familie Shawri het bevel gekregen om het grondgebied te verlaten, wat betekent dat de ouders na de begrafenis van hun kind moeten kiezen tussen clandestien proberen doorreizen naar Engeland, in Belgi\u00eb alsnog proberen asiel aan te vragen met een zeer lage kans op slagen of hun repatri\u00ebring naar Irak te aanvaarden. Van hun kant, de ouders van Mawda wensen in belgie te blijven, dicht bij het lichaam van hun dochter. Tevens vragen de ouders dat een ernstig onafhankelijk onderzoek wordt gevoerd zodat de waarheid over de moord op hun dochtertje aan het licht kan kome<\/p>\n<p><strong>Een verblijfsrecht voor het gezin<\/strong><\/p>\n<p>De familie Shawri kan niet zomaar het lichaam van Mawda op een Belgische begraafplaats achterlaten. Volgens de voorzitter van het OCMW van Mons, waar de familie Shawri momenteel is gehuisvest, bevinden we ons in een \u201chumanitaire noodsituatie\u201d. \u2028Geconfronteerd met een regering die zich graag verschuilt achter juridische regels, herinneren wij graag aan Artikel 9bis van de wet van 15 december 1980 betreffende de toegang tot het grondgebied, het verblijf, de vestiging en de verwijdering van vreemdelingen. Dit artikel voorziet immers in de mogelijkheid om van de gebruikelijke procedure (dat een aanvraag voor een verblijfsvergunning van langer dan drie maanden moet worden aangevraagd in het land van herkomst) af te wijken. Indien een persoon reeds in Belgi\u00eb verblijft en het onmogelijk of zeer moeilijk is om naar zijn land van herkomst terug te keren, kan hij in Belgi\u00eb een aanvraag indienen voor buitengewone omstandigheden. \u2028Volgens ons is dit hier duidelijk het geval.<\/p>\n<p><strong>Daarom eisen we dat de eerste minister zo snel mogelijk het recht op verblijf verleent aan de familie Shawri om humanitaire redenen. \u00ab\u00a0Alleen onmiddellijke regularisatie, los van de voortzetting van een gerechtelijke of administratieve procedure, zal de ouders in staat stellen het onderzoek te volgen (&#8230;) en hun rouw waardig te kunnen beleven\u00a0\u00bb (Persconferentie van Cir\u00e9, 23\/05\/2018). Dit verblijfsrecht stelt de ouders tevens in de mogelijkheid een onafhankelijk parlementair onderzoek aan te vragen zodat gerechtigheid voor Mawda kan geschieden.<\/strong><\/p>\n<p><strong>__________________________________________<a href=\"https:\/\/www.change.org\/p\/charles-michel-pour-la-r\u00e9gularisation-imm\u00e9diate-et-d\u00e9finitive-de-la-famille-shawri?utm_medium=email&amp;utm_source=petition_signer_receipt&amp;utm_campaign=triggered&amp;share_context=signature_receipt&amp;recruiter=127412\">Signer<\/a><\/strong><strong>_______________________<\/strong><\/p>\n<p>On Thursday 17 May 2018, Mawda Shawri was killed by the Belgian police.The young child was born in Germany to parents who were fleeing Iraqi Kurdistan in the hope of reaching England. She was struck in the head by a bullet when the police opened fire on a van transporting migrants near the town of Mons in Belgium. Her death was a direct consequence of the repressive policy towards \u00ab\u00a0undocumented\u00a0\u00bb migrants that has been adopted by the current government. As a result, people who are fleeing war, poverty and oppression are forced to take ever greater risks in order to avoid the Belgian security forces, in the hope of rebuilding their lives on the other side of the Channel. Following Mawda&rsquo;s death, the Shawri family has received a legal order to quit Belgian territory. As a result, after burying their daughter, the parents will have the choice between continuing to try and make their way to England clandestinely, introducing an application for asylum in Belgium which is almost certain to be rejected, or agreeing to their voluntary repatriation to Iraq.<br \/>\nMawda&rsquo;s parents have already asked that they be allowed to remain in Belgium so they can be near their daughter&rsquo;s body. They also demanded a serious and independent inquiry to be opened in order to uncover the whole truth of how she came to be killed.<\/p>\n<p><strong>The Shawri family should be granted immediate and permanent residence<\/strong><\/p>\n<p>Practically speaking, the Shawri family can neither abandon its daughter&rsquo;s remains in a Belgian cemetery and continue its journey, nor can it remain in Belgium. The president of the Mons Social Security office, which provided the Shawri&rsquo;s with accommodation, stated that \u00ab\u00a0their situation clearly constitutes a humanitarian emergency\u00a0\u00bb. The Belgian government, however, is only interested in the letter of the<br \/>\nlaw. And it is true that, in theory, any application for more than three months&rsquo; residence in Belgium must be made through the Belgian consulate or diplomatic mission in the country of origin of the person making the application. However, we would also remind the government of Belgium that article 9 bis of the law of 15 December 1980 &#8211; the law on access to the national territory, residence, establishment and departure of foreign nationals &#8211; provides for an exemption from this procedural rule. This means that, in certain circumstances, it is possible to introduce an application from within Belgium when the applicant is already on the<br \/>\nnational territory, including in the case of those who are in transit through the country, and of those who have entered it illegally. If it is impossible or extremely difficult for a person who is already in Belgium to return to their country of origin, they may apply from Belgium on the grounds of exceptional circumstances. The situation of the Shawri family clearly constitutes such an exception. That is why<strong> we <\/strong><strong>demand that the Prime Minister immediately grant the Shawri family <\/strong><strong>permanent residence in Belgium on humanitarian grounds. \u00ab\u00a0Only their immediate regularisation, without waiting for the outcome of any legal or administrative procedure, will allow the parents both to participate <\/strong><strong>in the inquiry (&#8230;) and to mourn their daughter with dignity\u00a0\u00bb<\/strong> (Press release of the Cir\u00e9, 23\/05\/2018). <strong>By granting them the right to <\/strong><strong>permanent residence, such a decision would also make it possible for the <\/strong><strong>Shawri family to see that justice is done to Mawda, in the form of an<\/strong><br \/>\n<strong>independent parliamentary
