(14 juin 2018) – Tariq Ramadan, intellectuel et professeur respect\u00e9 de l’universit\u00e9 d’Oxford, a \u00e9t\u00e9 plac\u00e9 en d\u00e9tention provisoire dans une prison fran\u00e7aise et priv\u00e9 de libert\u00e9 sous caution suite \u00e0 des all\u00e9gations de viol qu’il nie avec v\u00e9h\u00e9mence.<\/p>\n

Incarc\u00e9r\u00e9 depuis plus de quatre mois, Tariq Ramadan s’est vu refuser un traitement m\u00e9dical appropri\u00e9 d\u2019une affection m\u00e9dicale ant\u00e9rieure grave et s’est vu refuser l’acc\u00e8s \u00e0 son dossier judiciaire complet.<\/p>\n

Les magistrats fran\u00e7ais semblent ignorer les diagnostics de neuf m\u00e9decins stipulant que le professeur Ramadan souffre d\u2019une scl\u00e9rose en plaques, y compris l\u2019avis de l’autorit\u00e9 m\u00e9dicale en chef de la prison qui a confirm\u00e9 que son \u00e9tat de sant\u00e9 n’\u00e9tait pas compatible avec le maintien en incarc\u00e9ration.<\/p>\n

En r\u00e9ponse, un appel international \u00e9mis par des journalistes, des politiciens, des universitaires et des chercheurs qui s’expriment dans une lettre ouverte. Parmi les signataires : l’auteure anglaise Karen Armstrong; le philosophe canadien Charles Taylor; le cin\u00e9aste britannique Ken Loach; Dr Amina Wadud de Berkeley; le journaliste britannique Peter Oborne; le professeur John Esposito de l’universit\u00e9 de Georgetown et l\u2019universitaire Hamza Yusuf.<\/p>\n

En tant que personnalit\u00e9s, chercheurs et politiciens du monde entier, nous \u00e9crivons pour exiger une proc\u00e9dure \u00e9quitable pour le professeur Tariq Ramadan, incarc\u00e9r\u00e9 depuis le 2 f\u00e9vrier dans une prison fran\u00e7aise.<\/p>\n

Ce n’est pas \u00e0 nous de juger de la culpabilit\u00e9 ou de l’innocence du professeur Ramadan. Mais nous souhaitons rappeler au pays qui a affirm\u00e9 l’inali\u00e9nabilit\u00e9 des droits de l’Homme et l’\u00e9galit\u00e9; l’importance du respect des principes qui garantissent l’int\u00e9grit\u00e9 de la justice fran\u00e7aise.<\/p>\n

Ainsi, nous posons la question: Pourquoi M. Ramadan a-t-il \u00e9t\u00e9 priv\u00e9 de libert\u00e9 sous caution lors de l’enqu\u00eate pr\u00e9liminaire? Ceci bien qu’il se soit rendu volontairement \u00e0 l’interrogatoire et ait donn\u00e9 toutes les garanties requises?<\/p>\n

Mr. Ramadan a-t-il b\u00e9n\u00e9fici\u00e9 de l’\u00e9galit\u00e9 de traitement tant appr\u00e9ci\u00e9e par la France, alors que des personnalit\u00e9s politiques de haut rang accus\u00e9es de faits similaires continuent de b\u00e9n\u00e9ficier de leur libert\u00e9 de mouvement?<\/p>\n

Existe-t-il une forme de justice pour les musulmans en France et une autre pour tous les autres?<\/p>\n

Qu\u2019est-ce qui justifie sa mise en isolement, les droits limit\u00e9s de visites familiales, le refus d\u2019acc\u00e8s \u00e0 son dossier judiciaire\u00a0et donc aux moyens n\u00e9cessaires pour pr\u00e9parer sa d\u00e9fense?<\/p>\n

Les magistrats peuvent-ils permettre les fuites d\u2019informations de mani\u00e8re s\u00e9lective en toute impunit\u00e9? Est-ce une habitude en France que des personnalit\u00e9s politiques de haut rang d\u00e9nigrent publiquement une personne en attente de proc\u00e8s?<\/p>\n

En bref, nous posons respectueusement la question: Mr Ramadan b\u00e9n\u00e9ficie-t-il d’une proc\u00e9dure judiciaire juste et \u00e9quitable, dans laquelle il est pr\u00e9sum\u00e9 innocent jusqu’\u00e0 preuve du contraire?<\/p>\n

Nous demandons donc l\u2019application et le respect d\u2019une justice \u00e9galitaire et impartiale.<\/p>\n

Nous tenons \u00e9galement \u00e0 faire part de notre profonde pr\u00e9occupation pour la dignit\u00e9 et le traitement humain de tous les prisonniers.<\/p>\n

(June 14, 2018) \u2013 Respected Oxford University Professor and public intellectual Tariq Ramadan has been held in preventative detention in a French prison and denied bail following allegations of rape to which he vehemently denies.<\/p>\n

Incarcerated for over four months, Tariq Ramadan was denied appropriate treatment for a serious pre-existing medical condition and denied access to his full legal file.<\/p>\n

French magistrates appeared to ignore the diagnoses of nine physicians that Professor Ramadan suffers from Multiple Sclerosis, including the chief prison medical authority, who confirmed that his state of health is not compatible with continued incarceration.<\/p>\n

In response, a worldwide appeal of journalists, politicians, scholars and academics are speaking out in an\u00a0open letter. Signatories include English author Karen Armstrong, Canadian philosopher Charles Taylor, UK filmmaker Ken Loach, Dr Amina Wadud from Berkeley, UK journalist Peter Oborne, Professor John Esposito from Georgetown University, scholar Hamza Yusuf, among many others.<\/p>\n

\u201cWe wish to remind the country that affirmed the inalienability of human rights and equality, the importance of respecting principles that ensure the integrity of French justice.\u201d<\/p>\n

The letter also expresses deep concern with the inhuman treatment that Tariq Ramadan has been subject to at the hands of French justice.<\/p>\n

OPEN LETTER: <\/strong>A WORLDWIDE APPEAL FOR DUE PROCESS FOR TARIQ RAMADAN<\/strong><\/p>\n

A Worldwide Appeal for Due Process for Tariq Ramadan. After four months of pre-trial detention, Tariq Ramadan\u2019s last appeal for bail has again been denied.<\/p>\n

As scholars and politicians from around the world, we write to demand due process for Professor Tariq Ramadan, incarcerated since February 2nd in a French prison.<\/p>\n

It is not for us to judge Tariq Ramadan\u2019s guilt or innocence. We fully recognize the rights of the plaintiffs to have their case heard without prejudice and without injury to their honour. But we wish to remind the country that has affirmed the inalienability of human rights and equality of the importance of respect for the principles that ensure the integrity of French justice.<\/p>\n

We ask: Why has Mr. Ramadan been denied bail at the preliminary investigative stage although he willingly came for questioning and has given all required guarantees?<\/p>\n

Has Mr. Ramadan been granted the equal treatment so prized by France when high-ranking political figures accused of similar offenses continue to enjoy full freedom of movement?<\/p>\n

Is there one form of justice for Muslims in France and another for everyone else?<\/p>\n

What justifies solitary confinement, limited family visitation rights, the denial of access to his case file and thus to the necessary means of preparing his defense?<\/p>\n

Can prosecutors selectively leak information with impunity? Is it standard procedure in France for high-ranking political figures to publicly denigrate someone awaiting a trial?<\/p>\n

In short, we respectfully ask, has Mr. Ramadan benefitted from a fair and equitable legal process, one in which he is presumed innocent until proven guilty?<\/p>\n

These are straightforward questions of equal justice. To them we add deep concern for the dignity and humane treatment of all prisoners.<\/p>\n

French magistrates have appeared to ignore the diagnoses of nine physicians that Mr. Ramadan suffers from multiple sclerosis, including the chief prison medical authority, who confirmed that his state of health is not compatible with continued incarceration.<\/p>\n

Even though Mr. Ramadan suffers from multiple sclerosis and further neurological complications, proper medical treatment has not been provided.<\/p>\n

We understand that the defense has appealed to the European Court of Human Rights against undue suffering he has undergone at the hands of the French justice.<\/p>\n

We ask our French friends: should it truly come to this?<\/p>\n

We, the signatories of this letter, endorse France\u2019s commitment to uphold the values of libert\u00e9<\/em>, \u00e9galit\u00e9<\/em> et fraternit\u00e9 <\/em>threatened today around the world.<\/p>\n
