Une fen\u00eatre entre ouverte depuis 2019, par le juge Tucker qui a enfin admis qu\u2019il y avait des vices de proc\u00e9dure, entre autres nombreux faits volontairement ignor\u00e9s par la justice), ce qui permet enfin \u00e0 Mumia d\u2019interjeter appel. Les d\u00e9clarations racistes de Ronald Castille, d\u2019abord procureur adjoint puis premier juge \u00e0 la Cour supr\u00eame de Pennsylvanie dans les diff\u00e9rents proc\u00e8s contre Mumia, ont pr\u00e9empt\u00e9 son droit \u00e0 un proc\u00e8s juste et impartial et surtout viol\u00e9 son droit \u00a0\u00e0 \u00eatre prot\u00e9g\u00e9 par la Constitution, entre autres avec la \u00a0\u00a0r\u00e9cusation\u00a0massive des jur\u00e9s afro-am\u00e9ricains.<\/p>\n<p>Sa situation juridique interroge. Dans ce pays s\u2019auto proclamant la plus grande d\u00e9mocratie et o\u00f9 il aura fallu l\u2019assassinat de George Floyd en direct, les mobilisations des jeunes Afro-am\u00e9ricains pour qu\u2019il reconnaisse avoir un probl\u00e8me avec la racialisation, les \u00e9vidences ne suffisent pas. Le procureur de Philadelphie, Larry Krasner, a contest\u00e9 la d\u00e9cision du juge Tucker.<\/p>\n<p>Cette r\u00e9ouverture du proc\u00e8s Mumia pourrait servir d\u2019exemple aux Afro-am\u00e9ricains, innocents,\u00a0 attendant dans les couloirs de la mort et qui font face \u00e0 une justice qui a rendu un verdict biais\u00e9 par l\u2019utilisation de la race agissant comme un r\u00e9gime de pouvoir sur les corps noirs, permettant au capitalisme lib\u00e9ral de se maintenir.\u00a0 Krasner voulait \u00e9viter \u00e0 tout prix que ce cas serve de jurisprudence. Mais c\u2019\u00e9tait sans compter sur la d\u00e9termination du juge Tucker, qui n\u2019a pas c\u00e9d\u00e9. Encore une fois, nous attendons, le poing lev\u00e9, de conna\u00eetre les dates des prochaines audiences. Nous serons pr\u00e9sents, debout, et feront encore face aux regards inhumains des soutiens de Daniel Faulkner.<\/p>\n<p>Cette fa\u00e7on particuli\u00e8re de traiter les prisonniers politiques n\u2019est pas sp\u00e9cifique aux Etats Unis, o\u00f9 Leonard Peltier, prisonnier politique, incarc\u00e9r\u00e9 depuis 45 ans, pour un crime qu\u2019il nie avoir commis, lib\u00e9rable depuis des ann\u00e9es, attend de sortir. En France, Georges Ibrahim Abdallah est lib\u00e9rable depuis 20 ans alors qu\u2019il est en prison depuis 38 ans et qu\u2019aucune preuve qu\u2019il a particip\u00e9 au crime dont on l\u2019accuse.<\/p>\n<p>Sans oublier les prisonniers palestiniens subissant l\u2019occupation ill\u00e9gale et faisant face \u00e0 un occupant, violant ses obligations internationales \u00e0\u00a0 l\u2019\u00e9gard de la population civile et des personnes d\u00e9tenues, avec ou sans proc\u00e8s, avec ou sans preuve, jug\u00e9es par des tribunaux militaires alors qu\u2019il s\u2019agit de personnes civiles ou arr\u00eat\u00e9es sur des pr\u00e9somptions au pr\u00e9texte de lutter contre le terrorisme. Occupant faisant subir torture, traitements d\u00e9gradants et humiliants d\u00e9nonc\u00e9s comme crimes de guerre dans le statut de Rome<a href=\"https:\/\/fondation-frantzfanon.com\/the-international-dimension-of-mumias-case-and-international-campaign-for-freedom\/?fbclid=IwAR0CAdFrUFQX-I-CKIvbC_NYOEHLtl-rfprLCZfUk6H9ik9o04jCMbLVg7s#_ftn1\">[1]<\/a>\u00a0, violant ainsi l\u2019ensemble de ses obligations en termes et qui refuse de se soumettre aux normes imp\u00e9ratives du droit humanitaire international et du droit international avec l\u2019aide de ses nombreux alli\u00e9s.<\/p>\n<p>Nul doute que cette \u00e9volution judiciaire est \u00e0 mettre au cr\u00e9dit de la d\u00e9termination de sa famille, de ses nombreux soutiens, des diff\u00e9rentes mobilisations aux Etats-Unis mais aussi partout dans le monde portant l\u2019exigence d\u2019une justice non racialis\u00e9e et du combat contre le racisme structurel afin de mettre fin \u00e0\u00a0 des d\u00e9cisions inhumaines et discriminatoires. D\u00e9termination sans faille de ses avocats qui ont suivi les convictions des soutiens et se sont gliss\u00e9s dans les interstices laiss\u00e9s par une justice dominatrice. Ne rien c\u00e9der, ne rien abdiquer. C\u2019est aussi cela que porte Mumia, la conviction que son innocence sera reconnue et que nous serons l\u00e0 lorsque les portes de la prison de Mahanoy s\u2019ouvriront. Quand la police et la justice vont elles reconna\u00eetre qu\u2019ils se sont tromp\u00e9es\u00a0? \u00a0Daniel Faulkner\u00a0n\u2019a pas \u00e9t\u00e9 tu\u00e9 par Mumia Abu Jamal.<\/p>\n<p>Ce n\u2019est certainement pas pour demain. Un pr\u00e9sum\u00e9 coupable a \u00e9t\u00e9 trouv\u00e9. Ni la justice ni la police ne vont le l\u00e2cher. Il n\u2019est qu\u2019\u00e0 constater la fa\u00e7on dont les soutiens de la veuve de Daniel Faulkner se jettent sur les bancs de la salle d\u2019audience, dont les policiers se tiennent, tel un rempart rempli de violence et d\u2019arrogance, devant les soutiens de Mumia\u00a0; on peut l\u00e9gitiment se demander si cet \u00e9talage de forces n\u2019a pas pour fonction de signifier aux soutiens de Mumia mais aussi aux juges, qui feraient \u0153uvre d\u2019objectivit\u00e9 et d\u2019ind\u00e9pendance, ainsi que le n\u00e9cessite leur fonction, qu\u2019ils veillent et qu\u2019ils feront tout pour que ce prisonnier politique, devenu symbole de l\u2019\u00e9mancipation des Afro-am\u00e9ricains et bien au-del\u00e0, meure en prison. Pour eux, ce n\u2019est qu\u2019\u00e0 ce prix que leur coll\u00e8gue sera veng\u00e9.<\/p>\n<p>Les prisonniers politiques, dont les droits fondamentaux sont refus\u00e9s et ni\u00e9s o\u00f9 que ce soit, sont une des donn\u00e9es de la r\u00e9pression et un des moyens trouv\u00e9s par les dominants pour imposer un nouvel ordre mondial qui lutte contre l\u2019ensemble des peuples afin d\u2019assurer la financiarisation et la marchandisation du monde.<\/p>\n<p>Le syst\u00e8me capitaliste a besoin de coupables et de vengeance. Aux Etats unis, c\u2019est encore plus vrai, sous une justice pr\u00e9tendue juste, on assiste \u00e0 une parodie de justice ou \u00e0 une justice exp\u00e9ditive qui n\u2019a besoin que de revanche, particuli\u00e8rement lorsque la vie de policiers est en jeu. Certains syndicats de policiers, tel l\u2019Ordre fraternel de la police, veillent \u00e0 ce que ceux qui ont commis un crime contre un policier soient arr\u00eat\u00e9, jug\u00e9 et surtout incarc\u00e9r\u00e9 pour un temps long.<\/p>\n<p>Parler de Mumia c\u2019est aussi attendre ses \u00e9crits dans lesquels sont d\u00e9taill\u00e9s et analys\u00e9s, avec une grande pr\u00e9cision, les actes inhumains de ceux qui dominent les invisibles et les r\u00e9duits au silence, qu\u2019ils soient racis\u00e9s, pr\u00e9caires ou marginalis\u00e9s. C\u2019est appr\u00e9hender le monde du dedans, privant de libert\u00e9 et m\u00eame du droit \u00e0 la vie, tel que d\u00e9finit dans quelques instruments internationaux, ceux qui ont commis des d\u00e9lits ou des crimes, peu importe qu\u2019ils soient coupables ou non.<\/p>\n<p>Les derniers chiffres, de 2017, font \u00e9tat de 2,2 millions de personnes derri\u00e8re les barreaux, sans oublier les 4,5 millions d\u2019autres sous contr\u00f4le judiciaire. 32\u00a0000 enfants de moins de 18 ans sont incarc\u00e9r\u00e9s tous les ans dans des prisons pour adultes\u00a0; selon le Sentencing Project, les taux d\u2019incarc\u00e9ration, dans 37 Etats, \u00e9taient plus \u00e9lev\u00e9s pour les enfants noirs que pour les blancs.<\/p>\n<p>Les hommes noirs peuplant principalement les prisons (6 fois plus que les hommes blancs)\u00a0 vont peut-\u00eatre un jour \u00eatre concurrenc\u00e9s par les femmes noires dont le nombre de d\u00e9tenues a augment\u00e9 de 750% entre 1980 et 2017. Apr\u00e8s avoir eu une peur visc\u00e9rale de l\u2019homme noir, le syst\u00e8me capitaliste blanc ajoute les femmes noires \u00e0 sa peur\u00a0; elles sont 2 fois plus emprisonn\u00e9es que les femmes blanches.\u00a0 Avec ces chiffres que doivent envier quelques pays occidentaux et leurs alli\u00e9s du sud, les Etats Unis restent un mod\u00e8le en mati\u00e8re de subjugation et de contraintes sur les corps mais surtout sont le champion mondial de l\u2019emprisonnement.<\/p>\n<p>C\u2019est aussi prendre le temps de porter une attention particuli\u00e8re \u00e0 l\u2019homme, Mumia, qui depuis 40 ans, r\u00e9siste non seulement aux humiliations, aux pressions en faisant face, au quotidien, \u00e0 ses bourreaux qui pr\u00e9f\u00e9reraient le voir mort plut\u00f4t que vivant, humain, trop humain et debout. Mumia l\u2019homme qui d\u00e9range et qui renvoie au syst\u00e8me, qui l\u2019a condamn\u00e9, l\u2019inhumanit\u00e9 qui le constitue, sans jamais baisser la t\u00eate ou courber le dos.<\/p>\n<p>C\u2019est aussi s\u2019\u00e9tonner de cette force \u00e0 r\u00e9cup\u00e9rer des atteintes que son corps subit, sans rien l\u00e2cher. Sans rien c\u00e9der. Asthme, h\u00e9patite C, allergie importante, pathologie cardiaque, Covid 19\u2026 Et resurgir, continuer \u00e0 vivre, \u00e0 clamer son innocence, continuer \u00e0 penser, \u00e0 r\u00e9fl\u00e9chir, continuer \u00e0 \u00e9laborer \u00e0 propos d\u2019un monde d\u00e9viant. Continuer \u00e0 \u00eatre au monde alors que d\u2019o\u00f9 nous sommes, arrive parfois la tentation de baisser les bras et de renoncer. Mumia nous rappelle \u00e0 l\u2019ordre\u00a0; nous ne pouvons cesser tant que les combats essentiels dans la lutte contre les dominants n\u2019ont pas \u00e9t\u00e9 gagn\u00e9s.<\/p>\n<p>C\u2019est \u00e9couter ses chroniques sur Prison Radio, presque 1 000, \u00a0et s\u2019interroger sur sa capacit\u00e9 \u00e0 capter, \u00e0 travers l\u2019\u00e9paisseur des murs grillag\u00e9s des\u00a0 prisons o\u00f9 il a \u00e9t\u00e9 incarc\u00e9r\u00e9, les errements et les \u00e9ructations de violence d\u2019un monde guid\u00e9 par un nouvel ordre mondial dont le drapeau est cach\u00e9 par les crimes commis au nom d\u2019un capitalisme lib\u00e9ral raciste, inique et violent.<\/p>\n<p>Capitalisme qui pour assurer sa p\u00e9rennit\u00e9 a construit socialement le faux concept de race pour contraindre ceux qu\u2019il a arrach\u00e9s du continent africain, puis qu\u2019il a mis en esclavage en les d\u00e9shumanisant et en les privant de dignit\u00e9. Il a continu\u00e9 en compartimentant, en s\u00e9gr\u00e9gant les nouveaux affranchis apr\u00e8s les abolitions, sans oublier d\u2019octroyer de substantielles dites compensations \u00e0 leurs propri\u00e9taires bourreaux. \u00a0Il continue avec les racis\u00e9s du sud global ou du nord.<\/p>\n<p>Sans \u00e9tat d\u2019\u00e2me, ce syst\u00e8me de domination port\u00e9 par la Modernit\u00e9 euro-centr\u00e9e et la conviction que seule la supr\u00e9matie blanche pouvait guider le monde, a continu\u00e9 \u00e0 contr\u00f4ler les corps noirs en les assignant \u00e0 des zones p\u00e9riph\u00e9riques, autrement dit \u00e0 des zones de Non \u00catres. \u00a0En ce sens les complexes d\u2019enfermement que sont les prisons nord am\u00e9ricaines mais aussi isra\u00e9liennes sont autant de signaux qu\u2019envoient ce syst\u00e8me \u00e0 ceux qui seraient tent\u00e9s de le d\u00e9fier ou de ne pas suivre les r\u00e8gles d\u2019une vie en d\u00e9mocratie lib\u00e9rale et privative de libert\u00e9.<\/p>\n<p>Lutter pour la lib\u00e9ration des prisonniers politiques, c\u2019est s\u2019engager \u00e0 lutter contre le racisme structurel de l\u2019Etat que l\u2019Etat exerce \u00e0 l\u2019\u00e9gard des corps noirs et arabes et \u00e0 l\u2019\u00e9gard des Palestiniens qui vivent sous apartheid. Cette lutte contre le racisme structurel ne suffit pas en elle-m\u00eame pour changer le paradigme de la domination\u00a0; il faut \u00e0 la fois d\u00e9noncer et lutter contre le racisme structurel et contre le capitalisme lib\u00e9tal. A window has been opened since 2019, by Judge Tucker who finally admitted that there were procedural flaws, among other many facts intentionally ignored by the courts), which finally allows Mumia to appeal.<\/p>\n<p>The racist statements of Ronald Castille, first deputy prosecutor and then Chief Justice of the Supreme Court of Pennsylvania in the various trials against Mumia, preempted his right to a fair and impartial trial and above all violated his right to be protected by the Constitution, among others with the mass exclusion of African-American jurors.<\/p>\n<p>His legal situation raises questions. In this country which proclaims itself the greatest democracy and where it took the assassination of George Floyd live, the mobilizations of young African-Americans, the State has difficulty recognizing the problem of structural racism, the evidence is still not sufficient so that Philadelphia District Attorney, Larry Krasner challenged Judge Tucker\u2019s ruling.<\/p>\n<p>This reopening of the Mumia case could serve as an example for innocent African Americans waiting on death row and facing a justice that has rendered a verdict biased by the use of race acting as a regime of power on black bodies, allowing liberal capitalism to maintain itself. Krasner wanted to avoid at all costs that this case serve as a precedent. But that was without relying on the determination of Judge Tucker, who did not give in. Once again, we are waiting with raised fists to know the dates of the next hearings, still facing the inhuman gazes of the supporters of Daniel Faulkner.<\/p>\n<p>This particular way of treating political prisoners is not specific to the United States, where Leonard Peltier, a political prisoner, incarcerated for 45 years, for a crime he denies having committed, is waiting to be released. In France, Georges Ibrahim Abdallah is releasable for 20 years while he has been in prison for 38 years with no evidence that he participated in the crime of which he is accused.<\/p>\n<p>Without forgetting the Palestinian prisoners undergoing the illegal occupation and facing an occupier, violating its international obligations towards the civilian population and those detained, with or without trial, with or without proof, tried by military courts then. whether they are civilians or people arrested on suspicion on the pretext of fighting terrorism. Occupier subjecting torture, degrading and humiliating treatment denounced as war crimes in the Rome Statute, thus violating all of its obligations in terms of who refuses to submit to the peremptory standards of international humanitarian law and international law with the help of his many allies.<\/p>\n<p>There is no doubt that the judicial development, involving Judge Tucker, is to the credit of the determination of Mumia\u2019s family, of his numerous supporters, of the various mobilizations in the United States but also throughout the world bearing the demand for non-racialized justice and the fight against structural racism in order to put an end to inhumane and discriminatory decisions.<\/p>\n<p>It is also the conviction Mumia carries, the belief in his innocence and that we will somehow will triumph with the truth when the police and the judiciary will finally have to agree that their narrative about who killed\u00a0 Daniel Faulkner is wrong. And we will be there when the doors of Mahanoy Prison open for Mumia to walk out.<\/p>\n<p>It\u2019s certainly not for tomorrow. A suspected culprit has been found. Neither justice nor the police will let him go.
