Le tribunal correctionnel de Tournai a prononc\u00e9 ce 06 janvier 2022 l\u2019acquittement de Nordine Saidi et de Bruxelles Panth\u00e8res poursuivis pour s\u2019\u00eatre oppos\u00e9s au folklore raciste de ce qui se faisait appeler jusqu\u2019en 2018 \u00a0\u00bb La grande sortie des N\u00e8gres \u00a0\u00bb (sic).<\/div>\n<\/div>\n

Nordine Saidi et Bruxelles Panth\u00e8res \u00e9taient poursuivis d\u2019une part pour \u00ab\u00a0menaces\u00a0\u00bb et d\u2019autre part pour \u00a0\u00bb harc\u00e8lement \u00a0\u00bb le tout en \u00a0\u00bb contexte terroriste \u00ab\u00a0.<\/div>\n<\/div>\n

Nordine Saidi \u00e9tait d\u00e9fendu par Me Selma Benkhelifa et Me Nicolas Cohen.<\/div>\n<\/div>\n

Il a aussi \u00e9t\u00e9 soutenu par une forte mobilisation, port\u00e9e aussi bien \u00e0 l’\u00e9chelle locale, nationale qu’internationale, par des activistes, des citoyens, des artistes, des chercheurs etc.<\/div>\n
Le tribunal correctionnel de Tournai a acquitt\u00e9 Nordine Saidi de toutes les charges qui pesaient contre lui. Le tribunal a insist\u00e9 sur la l\u00e9gitimit\u00e9 du mobile et des moyens utilis\u00e9s, consid\u00e9r\u00e9s comme non mena\u00e7ant pour toute personne raisonnable.<\/div>\n<\/div>\n

En ce qui concerne les plaignants, le tribunal insiste sur le fait que Nordine Saidi s’adressait bien au bourgmestre et aux mandataires politiques dans leurs capacit\u00e9s \u00e0 agir contre le folklore n\u00e9grophobe.<\/div>\n<\/div>\n

Bruxelles Panth\u00e8res se r\u00e9jouit que le tribunal, \u00e0 la suite du r\u00e9quisitoire du Minist\u00e8re Public, mette finalement en \u00e9chec les tentatives d’\u00e9touffement de l\u2019interpellation politique.<\/div>\n<\/div>\n

En l\u2019esp\u00e8ce, une interpellation du Conseil Communal de Lessines, tous partis, tendances, genres, couleurs incluses, etc., a fini en correctionnelle ! MR, Ecolo, PS, CDH, Droite, Gauche, Centre, l\u2019ensemble du Conseil Communal ne se sont jamais oppos\u00e9s \u00e0 cette tentative.<\/div>\n<\/div>\n

Bruxelles Panth\u00e8res se f\u00e9licite de cette victoire judiciaire et d\u00e9nonce une fois de plus une instrumentalisation de la justice.<\/div>\n<\/div>\n

Que cette affaire soit all\u00e9e aussi loin et que les ressources des appareils policier et judiciaire aient \u00e9t\u00e9 mobilis\u00e9s pendant de nombreux mois est en soi un probl\u00e8me.<\/div>\n
Il s\u2019agit aussi d\u2019un moment important dans la lutte antiraciste.<\/div>\n
M\u00eame si l\u2019issue d\u2019aujourd\u2019hui est favorable, cette affaire n\u2019aurait jamais d\u00fb mobiliser un tribunal correctionnel.<\/div>\n
Un appel de la partie adverse reste malgr\u00e9 tout possible.<\/div>\n
Il nous faut continuer \u00e0 d\u00e9noncer le folklore n\u00e9grophobe, antis\u00e9mite ou islamophobe \u00ab\u00a0par tous les moyens n\u00e9cessaires\u00a0\u00bb .<\/div>\n
Mobilisons-nous pour notre droit \u00e0 l’interpellation politique pour un avenir D\u00e9colonial et antiraciste.<\/div>\n

The criminal court of Tournai has ruled this January 6, 2022, the discharge of Nordine Saidi and Brussels Panthers prosecuted for having opposed the racist folklore of what was called until 2018 \u00ab\u00a0La grande sortie des N\u00e8gres\u00a0\u00bb (sic).<\/p>\n

Nordine Saidi and Brussels Panthers were prosecuted on the one hand for \u00ab\u00a0threats\u00a0\u00bb and on the other hand for \u00ab\u00a0harassment\u00a0\u00bb all in a \u00a0\u00bb terrorist context \u00ab\u00a0.<\/p>\n

Nordine Saidi was represented by Me Selma Benkhelifa and Me Nicolas Cohen.<\/p>\n

He was also supported by a strong mobilization, carried locally, nationally and internationally, by activists, citizens, artists, scholars, etc.<\/p>\n

The Tournai correctional court discharged Nordine Saidi of all of the accusations against him. The court insisted on the legality of the motive and the means used, considered as not threatening for any reasonable person.<\/p>\n

As far as the plaintiffs are concerned, the court insists that Nordine Saidi was indeed addressing the mayor and the political representatives in their capacity to act against negrophobic folklore.<\/p>\n

Brussels Panthers is pleased that the court, following the indictment of the Public Prosecutor’s Office, finally thwarted the attempts to repress the political interpellation.<\/p>\n

In this case, an interpellation to all members of the Lessines Local Council, including all parties, tendencies, genders, colors, etc., ended up in the correctional court! MR, Ecolo, PS, CDH, Right, Left, Center, the entire Local Council never opposed this attempt.<\/p>\n

Brussels Panthers is pleased with this legal success and denounces once again the instrumental use of justice.<\/p>\n

That this case has gone so far and that the resources of the police and judicial authorities have been mobilized for many months is in itself a serious concern.<\/p>\n

Nevertheless, it is also an important moment in the anti-racist struggle.<\/p>\n

Even if today’s outcome is positive, this case should never have mobilized a criminal court.<\/p>\n

An appeal by the plaintiff is still possible.<\/p>\n

We must continue to denounce negrophobic, anti-Semitic or Islamophobic folklore \u00ab\u00a0by any means necessary\u00a0\u00bb.<\/p>\n

We shall keep mobilizing for our right to political interpellation for a decolonial and anti-racist future.<\/p>\n

El tribunal penal de Tournai ha dictaminado este 6 de enero de 2022 la absoluci\u00f3n de Nordine Saidi y Bruxelles Pantheres procesados por haberse opuesto al folclore racista de lo que se llam\u00f3 hasta 2018 \u00ab\u00a0La gran salid de Negros\u00a0\u00bb (sic).<\/p>\n

Nordine Saidi y Bruxelles Pantheres fueron procesados, por \u00ab\u00a0amenazas\u00a0\u00bb y,\u00a0 por \u00ab\u00a0acoso\u00a0\u00bb, todo ello en un \u00ab\u00a0contexto terrorista\u00a0\u00bb.<\/p>\n

Nordine Saidi fue defendido por Selma Benkhelifa y Nicolas Cohen.<\/p>\n

Tambi\u00e9n cont\u00f3 con el apoyo de una fuerte movilizaci\u00f3n, llevada a cabo a nivel local, nacional e internacional, por activistas, ciudadanos, artistas, acad\u00e9micos, etc.<\/p>\n

El tribunal correccional de Tournai liber\u00f3 a Nordine Saidi de todas las acusaciones que pesaban sobre \u00e9l. El tribunal insisti\u00f3 en la legalidad del motivo y los medios utilizados, considerados como no amenazantes para ninguna persona.<\/p>\n

Por lo que respecta a los demandantes, el tribunal insiste en que Nordine Saidi se dirig\u00eda efectivamente al alcalde y a los representantes pol\u00edticos en su capacidad de actuar contra el folclore negrof\u00f3bo.<\/p>\n

Bruxelles Pantheres se satisface de que el tribunal, tras la acusaci\u00f3n de la Fiscal\u00eda, haya frustrado finalmente los intentos de reprimir la interpelaci\u00f3n pol\u00edtica.<\/p>\n

En este caso, una interpelaci\u00f3n a todos los miembros del Consejo Local de Lessines, incluyendo todos los partidos, tendencias, g\u00e9neros, colores, etc., \u00a1acab\u00f3 en el tribunal correccional! MR, Ecolo, PS, CDH, Derecha, Izquierda, Centro, todo el Consejo Local nunca se opuso a este intento.<\/p>\n

Bruxelles Pantheres se satisface de este \u00e9xito jur\u00eddico y denuncia una vez m\u00e1s la instrumentalizaci\u00f3n de la justicia.<\/p>\n

Que este caso haya llegado tan lejos y que los recursos de las autoridades policiales y judiciales se hayan movilizado durante tantos meses es en s\u00ed mismo una cuesti\u00f3n muy preocupante.<\/p>\n

Sin embargo, tambi\u00e9n es un momento importante en la lucha antirracista.<\/p>\n

Aunque el resultado de hoy sea positivo, este caso nunca deber\u00eda haber movilizado un tribunal penal.<\/p>\n

Todav\u00eda es posible un recurso por parte del demandante.<\/p>\n

Debemos seguir denunciando el folclore negr\u00f3fobo, antisemita o islam\u00f3fobo \u00ab\u00a0por todos los medios necesarios\u00a0\u00bb.<\/p>\n

Seguiremos moviliz\u00e1ndonos por nuestro derecho a la interpelaci\u00f3n pol\u00edtica para un futuro d\u00e9colonial y antirracista.<\/p>\n
